Terms & Conditions

These Terms & Conditions apply to all websites and services operated by Daniel van der Velden (sole proprietorship) under the brand The Viking, including The Viking Automation, The Viking Webdesign, The Viking Coaching, and theviking.info.

By accessing any of our websites or engaging our services, you agree to be bound by these terms. If you do not agree, please do not use our websites or services.

1. Definitions

  • The Viking / we / us / our: Daniel van der Velden, sole proprietorship, Platanenlaan 142, 1613 TS Grootebroek, Nederland
  • You / Client / User: any person or entity using our websites or engaging our services
  • Services: coaching, automation, web design/development, plugin development, lead generation, and related services
  • Digital Products: downloadable resources, templates, plugins, or other digital materials

2. Use of the Website

You agree to use our websites for lawful purposes only. You may not misuse, disrupt, scrape without permission, or attempt to gain unauthorised access to any part of our systems.

3. Services & Deliverables

Service scope, deliverables, timelines, and pricing are defined in written proposals, emails, or agreements. Any work outside the agreed scope may require additional fees and timeline adjustments.

  • Automation services: custom n8n workflows; scope defined per project agreement
  • Webdesign: WordPress development; standard delivery 3-4 weeks from deposit
  • Coaching: session-based; schedule confirmed via TidyCal booking

4. Pricing & Payment

  • All prices exclude 21% Dutch VAT (BTW) unless stated otherwise
  • Standard payment: 50% deposit upfront, 50% on delivery for project work
  • Maintenance retainers: invoiced monthly in advance
  • Payment term: 7 days net
  • Late payments incur 1.5% monthly interest
  • Accepted methods: bank transfer (IBAN), PayPal (+3% fee)

5. Scheduling, Rescheduling & Cancellations

  • Sessions and calls must be scheduled via TidyCal in advance
  • Cancellations require at least 24 hours notice
  • Late cancellations or no-shows may be charged or forfeited depending on the service
  • Project work pauses if client content or feedback is not supplied within 7 days
  • Delays exceeding 14 days due to client inaction may incur a restart fee

6. Fees & Refunds

  • Refunds are generally not provided once work has started or a digital product has been delivered
  • Exceptions are at our sole discretion and must be confirmed in writing
  • For cancelled projects, you pay for work completed up to the cancellation date

7. Client Responsibilities

  • Provide timely feedback, approvals, content, and access credentials where required
  • Submit feedback in writing and consolidate per revision round
  • Use delivered materials and recommendations responsibly
  • Take responsibility for decisions and outcomes resulting from your own actions

8. Revisions

  • Webdesign projects include three revision rounds
  • Additional revisions are billed at €125/hour (minimum 1 hour)
  • Automation projects: scope changes require a new written agreement

9. Confidentiality

We treat all client information as confidential and will not disclose it to third parties without your permission, unless required by law or to deliver the service (e.g. hosting provider).

10. Intellectual Property

  • Full source code and deliverable ownership transfers to the client upon final payment
  • No vendor lock-in applies; all files and documentation are provided
  • Templates, methods, and frameworks developed by The Viking remain our intellectual property
  • You may not resell, redistribute, or commercially exploit our proprietary materials without prior written permission

11. Limitation of Liability

To the fullest extent permitted by Dutch law, The Viking is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability for any claim is limited to the amount paid for the specific service that gave rise to the claim.

12. Third-Party Tools & Links

  • We may integrate third-party tools (hosting, plugins, APIs, TidyCal, Stripe, etc.)
  • We are not responsible for third-party content, availability, or changes
  • Third-party costs (licences, hosting, API fees) are billed separately where applicable

13. Termination

  • Either party may end a service engagement at any time with written notice
  • You agree to pay for work completed up to the termination date
  • Access to delivered work may be withheld until all outstanding invoices are paid

14. Governing Law

These Terms & Conditions are governed by the laws of the Netherlands. Any disputes will be handled by the competent courts in Noord-Holland, unless mandatory law provides otherwise.

15. Changes to These Terms

We may update these Terms & Conditions periodically. The latest version is always posted on this page with an updated effective date. Continued use of our websites or services after changes constitutes acceptance.
